Unauthorized Seller Selling my ASINs, file report and got denied

Hi,

We noticed an unauthorized seller began selling under my ASIN in the same listing with much cheaper price.

We are the brand owner. And we have brand Registered with Amazon. We have never given permission to this seller to be able to sell any of our Product, ASINs, or Brand. This means that they are selling counterfeit products.

We used The Report a Violation Tool (https://www.amazon.com/report/infringement) and opened trademark infringement case, . but Amazon denied the report and said the report we submitted to Amazon are invalid or inaccurate. We do not know why. We opened case with seller support but no one gave us any help information as well.

So we want to ask, do we have to place test order for each trademark infringement before we file Infringement report otherwise Amazon won't accept trademark Infringement case without test order?

In the same time we were watching this unauthorized seller closely. We saw this unauthorized seller were selling under other brands on Amazon as well. This morning we noticed Amazon removed his offers for other brands. So how did other brands protected their ASINs without test orders?

I'll back up a second just for clarity since Brand Registry has been 'remodeled' over the last couple years and is a 'bit' of a mess.

Do you have the TM filed and approved at the USPTO? That can be a great starting point.

After that there are mixed reports as to whether they always require a test buy now. I haven't had to file a complaint for quite a while but I didn't before because my situation is the same as yours -- no others authorized.

@Seller_hKx4DTtM41w5e Test buys MAY be required but they are also a good idea because you can have proof if a product is, in fact, different than the listing itself and is infringing!

There are 2 Report a Violation (RaV) locations; one is in Seller Central and the other is accessed by logging into Brand Registry. Here is a direct link to the Report a Violation tool in Brand Registry. This video has step by step instructions for reporting a violation in Brand Registry beginning at the 2:50 mark of the video. We also had a post a few months ago providing deeper insight into How to Report a Violation through Amazon Brand Registry

Once one of your complaints are "accepted," by brand registry, the offer(s) will be removed.

One quick note, a very common mistake people make is reporting their own offer as well. Make sure to click on "Show Offers," after searching you ASIN and only select the offers that are violating your IP.

Not necessarily. Not authorized does not equal counterfeit.

I have had sellers file "counterfeit without a test buy" complaints against my account. I sue. They settle out of court.

Be sure to tie down your distribution channels before you are so sure that items are counterfeit without even seeing them. If the items are genuine, you committed the crime of libel and possibly several others.
