Seeking Advice on Addressing Unauthorized Seller Issue
Hello Fellow Sellers,
I’m reaching out to the community for guidance on an issue I’m facing with an unauthorized seller named 'Nani's Charm' listing under my ASIN B0CK5S2FCG. I am the owner of the brand 'VivaVerto', and we specialize in high-quality resistance bands. Recently, I’ve noticed that 'Nani's Charm' has listed my product at a lower price, which is quite concerning. My brand is not yet fully active in the Amazon Brand Registry due to a pending status, and I suspect this might be affecting my ability to control my listings.
Here is the link to my product: https://www.amazon.com/dp/B0CK5S2FCG

I am seeking advice on the following points:
What steps should I take to protect my brand and listings effectively, considering my Brand Registry status is still pending?
Has anyone experienced a similar situation and successfully removed an unauthorized seller?
Are there any immediate actions I can take to address this issue before my Brand Registry is approved?

I would appreciate any insights or recommendations on how to proceed with this situation. Your collective experience is a valuable resource, and any shared knowledge on this matter would be greatly beneficial.
Thank you in advance for your support and assistance.

And it should be. Where did you purchase/have made, your product. If it was in China, most likely this is what's happening.
When buyers have products made in China, often the manufacturer makes double of what was ordered by the seller. The extras are sold out the back door to friends and family. These kind people what until they see you create the listing on Amazon, then simply jump in on the sale at a lower cost, which is what you may be seeing.
Doing a test buy to prove the product is bogus, you find the product is not bogus, but an identical match. While this tactic in not accepted in the USA, it is accepted in China because it helps to create the national wealth of the country.
There are ways to prevent it that we will not go into now.

Do a test buy. If you do not receive your branded product then file an IP claim for counterfiet in Brand Registry. It will knock them off your listing.
We do it all the time. ust watch out. The big boys can sue for losses if thier accounts are impacted. Its hard to quantify the loss so they usually dont win much but the legal expense is enough to hurt most small businesses

Pending trademarks have no protection. Your eagerness to profit is now costing you.
No, the brand owner or representitve must manage the brand registry. You can do it yourself or get a brand rep to do it for you. We represent multiple brands with multiple trademarks. My experiance is that most brands are not good at the retail end.

Hate to say this I am not sure you have a case. Your trademark only protects the name I assume is "VivaVerto" The only place I see it listed is under the "visit VivaVerto store Is that your store? Reguarding the images unless they are copyrighted there realy is nothing you can do. You file a DMCA notice, the file a counter -notice you have 10 days to file a lawsuit in federal court plus unless you have the images copyrighted then nothin you can do. If they are selling a counterfit under your brand name then you have somethig to fight for.
